Can a wife be held accountable for opening credit card accounts in her husbands name without his consent?
My brother is at the beginnings of a divorce and his lovely wife *sarcasim* opened over 4 credit cards in his name without his knowing. Among other acts of deception including marrying him for health insurance to take care of a pregnancy and a child that she lied and said was his and taking money to pay her bills and then never paying them and then he later would have to pay them again........can he file for marriage fraud and identity theft?

- I think so. you cant use anyone else's information with out consent. So the question becomes is there enough evidence to prove that SHE opened the accounts and not him? Good luck to your brother!!
- Yes. He needs to file a criminal complaint against his wife for opening 4 credit card accounts without his knowledge or consent. The criminal charge should be larceny, but your brother will need to consult his own attorney about the particulars of the complaint. In addition, your brother should be seeking an annulment of his marriage as opposed to a divorce if he can prove he was deceived by his wife as defined by the annulment laws in his state. Good luck. - Yes she can be held accountable for the balance- he can close them too. During the divorce proceedings he needs to make note of the closing balances and put them as her responsibility legally. Sorry. As far as Fraud and identity theft they were legally married = legally responsible. It should resolve itself with the MSR (Marriage Settlement Report)
