I have been charged w/ ID Theft...?

I had a fake id that an old friend made me a long time ago, its not a good 1, and he waz jst "trying" to impress me w/ it or whatever.. i had put it in an older wallet that i started using again, and got pulled over and cops found it.. I have never used it for anything at all, just had it, 4got bout it, until they found it.. Another thing that makes this even worse, i had found a social security card in a parking lot also, a while back-picked it up for no other reason than to mail it to the dept.to get it back to owner,ect... i also 4got i even had this, until the cops found it.. i realize this does not look good, but is there anything i can do..?? i have been charged with Id theft, (felony) Can they really charge me w/this if i have never used them for anything, or had any attempt to.?or am i pretty much screwed cuz the were in my possess.? what also does not help me is i do have a criminal history, NO theft charges of any kind, drug possn charges in 1996-1998(felony) help pls...??

  1. it doesn't matter that you haven't used it.It's not like they would possibly call around to check anyway.Just having the thing is enough.
  2. Bad criminal history is the biggest thing against you; best thing to do is always stay quiet until you get a lawyer, and do get a lawyer...justice has no pity. PS: How old are you, if under 21 you might have chance for some relief.
  3. You are probably semi-screwed. . . You had the items in your possession. Your past criminal history gives you credibility problems. You don't explain why you were "pulled over". A mere traffic violation would not have the cops searching through your belongings, so I suspect you have other legal issues as well. Hopefully, your court appointed lawyer, can cut you a decent plea bargain. Good luck.
  4. Somehow there seems to be a lack of information here... If you weren't under arrest already, how did they have the authority to search your wallet? I'm leaping to the conclusion that in a search coincident to an arrest for something else, the police found you in possession of items that can be used in the commission of a crime. Absent a crime involving use of the fake ID, possession of the ID is a misdemeanor in most states.
  5. it doesn't matter it was in your possession. its your word against theirs. but dude that really sucks! THEY don't know if you tried to do something about it. they don't even care if you used it once or twice or at all. you still had it... get a lawyer... good luck

  7. With respect to the ID theft, the D.A. has a problem. To prove this crime (depending on your state law) they need to bring in the 'victim' to say that she never gave you the I.D. If she comes in and says she gave you an I.D. to buy alcohol, you're looking at a different misdemeanor. I wouldn't worry about this too much. With respect to the Social Security card, that is a larger problem. The victim is not going to say that you did not have permission to have it. Depending on when (s)he lost it and whether anyone else used that SSN fraudulently, you could facing a lot of problems. If the victim has also been the victim of identity theft (e.g. someone opened up a fake credit card) then the D.A. will assuming that you are the perpetrator thereof. Overall, unless you went to prison before, I doubt you are going in this case. Pray that the owner of the Social Security card has not had any problems. If you do not yet have a lawyer, it is officially time to get one, ASAP.
